1. Acceptance of Terms
By accessing or using Pattern5 (“Service”), operated by NHXHN, LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you may not use the Service.
These Terms apply to all users of the Service, including free and paid subscribers. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
2. Service Description
Pattern5 is a platform that serves curated architectural patterns, coding standards, architectural decision records, and guiding principles to AI coding agents via MCP (Model Context Protocol). Features include:
- Pattern, standard, decision record, and principle library with version control
- MCP server endpoint for AI agent integration (Claude Code, Cursor, GitHub Copilot, VS Code, Windsurf, and others)
- AI-assisted content creation using Azure OpenAI
- API key and OAuth authentication for secure agent access
- Organization and project management
- Usage analytics and rate limiting
- Subscription tiers (Free and Pro) with different usage limits
3. Account Registration
To use the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
- Be at least 13 years of age (or the minimum age in your jurisdiction)
We reserve the right to refuse service or terminate accounts at our sole discretion, particularly for violations of these Terms.
4. Subscriptions and Billing
- Free tier: 500 MCP requests/month, 5 AI generations/month, 1 project
- Pro tier ($10/seat/month): 5,000 MCP requests per seat/month, 100 AI generations per seat/month, 5 projects, team member invitations
Pro tier limits are per seat and pooled across the organization. For example, a 3-seat Pro subscription has a combined pool of 15,000 MCP requests and 300 AI generations per billing cycle.
Usage resets monthly: on the calendar month for Free accounts, and on the billing cycle anniversary for Pro subscriptions.
Billing is managed through Stripe. Subscription changes and cancellation are available through the billing portal accessible from your profile page.
No refunds are provided for partial billing periods unless required by applicable law.
5. Acceptable Use
You agree not to:
- Publish patterns or standards that contain malicious code, vulnerabilities, or intentionally harmful guidance
- Reverse engineer, decompile, or disassemble any part of the Service
- Circumvent rate limits or usage restrictions through any means
- Access the Service or other users' data without authorization
- Use automated means to access the Service except through the provided MCP endpoint and API
- Use data obtained from the Service to build a competing product or service
- Violate any applicable local, state, national, or international law
- Impersonate any person or entity or misrepresent your affiliation
We reserve the right to monitor usage and suspend or terminate accounts that violate these guidelines.
6. User Content and Intellectual Property
You retain ownership of the patterns, standards, decision records, and principles you create on Pattern5 (“User Content”).
By using the Service, you grant NHXHN, LLC a non-exclusive, worldwide, royalty-free license to host, display, and serve your content through the platform, including to AI agents via MCP. This license exists solely to operate the Service and terminates when your content is deleted.
NHXHN, LLC owns the Pattern5 platform, including its design, features, and functionality. Users can create and manage their own patterns, standards, decision records, and principles within the platform.
You are responsible for your User Content and must ensure you have all necessary rights to submit it.
7. AI-Generated Content
- AI-assisted features generate suggestions that may contain errors or inaccuracies
- You are responsible for reviewing and validating all AI-generated content before publishing
- AI-generated content is produced using Azure OpenAI and is subject to Azure's usage policies
- We do not guarantee the accuracy, completeness, or fitness of AI-generated content for any particular purpose
8. MCP Integration and API Access
- API keys and OAuth tokens provide programmatic access to your organization's published patterns
- You are responsible for securing your API keys and not sharing them with unauthorized parties
- Rate limits apply per organization based on your subscription tier
- We log MCP requests for analytics, security, and service improvement
- We may suspend API access for excessive use, abuse, or violations of these Terms
9. Privacy and Data
Our Privacy Policy describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.
10. Termination
We may terminate or suspend your account and access to the Service for violations of these Terms or for any other reason at our discretion. You may request account deletion by contacting support@pattern5.com.
Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and data after 30 days
- You remain liable for any charges incurred prior to termination
- Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will remain in effect
11. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, reliability, or availability of the Service
- Accuracy or completeness of patterns, standards, or AI-generated content served through the platform
Patterns and standards served via MCP are authored by users and generated by AI. They may contain errors. You are responsible for evaluating and testing any guidance before applying it to your codebase.
12. Limitation of Liability
To the maximum extent permitted by applicable law, NHXHN, LLC shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses.
Our total liability for all claims arising from or related to the Service will not exceed the amount paid by you for the Service during the twelve (12) months immediately preceding the date of the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless NHXHN, LLC and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including intellectual property rights
- Any claim that your User Content caused damage to a third party
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
You and NHXHN, LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
If a court of competent jurisdiction finds that the arbitration provision is unenforceable, the dispute will be resolved in the state or federal courts located in the State of Ohio, United States.
These Terms of Service are effective as of 2026-02-20.
